Privacy Policy Guidance for Our Clients

As you know, to ensure your marketing campaigns are performing at their peak, we utilize various data-collection tools such as Google Analytics. These technologies allow us to measure your return on investment, optimize your advertising spend, and ensure your brand reaches the most relevant audience.

These technologies also require disclosure in your website’s privacy policies. 

Modern privacy laws, such as the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA/CPRA), require businesses to be transparent about the data they collect.

It is critical that your website has an up-to-date Privacy Policy and Cookie Disclosure that accurately reflects these tools.

We are digital marketers, not attorneys. We are giving you a “friendly reminder” that your privacy policy should be updated at least once a year and that the tools we use on your behalf need to be stated in the policy, but we are not to be held liable for any errors or omissions that may or may not occur regarding your company’s privacy or cookie compliance.

Privacy & Cookie Policy Best Practices Checklist

Whether you write your own policy or use a tool, ensure your website meets these foundational standards:

  • Be Specific: Avoid vague language like “we may use your data.” Clearly state what you collect (names, IP addresses, etc.) and why (marketing, order fulfillment).
  • Disclose Third Parties: Explicitly list the services that receive user data (e.g., Google, Meta, HubSpot).
  • Explain User Rights: Clearly outline how a user can request to see, change, or delete their data.
  • Easy Access: Keep links to your Privacy and Cookie policies in your website footer so they are visible on every page.
  • Address Children’s Privacy: State whether your site is intended for users under 13 and how you handle such data (COPPA compliance).
  • Stay Current: Include a “Last Updated” date at the top and review the policy at least once a year.
  • Depending upon the regions your business targets, you may also need to implement a Cookie Consent banner.
